Patient Rights And Responsibilities

The Center Always Endeavors To Assure That These Rights Are Protected For Our Patients.

A. Right to impartial access to treatment or accommodations that are available or medically indicated regardless of race, creed, sex, national origin or sources of payment for care.

B. To have staff believe patient’s complaint of pain and to receive reasonable pain relief measure.

C. Patients are treated with respect, consideration and dignity. Patients are provided appropriate privacy.

D. Under the HIPAA (Health Information Portability and Accountability Act) Guidelines, which is Federal Law, patients’ protected health information (PHI) is treated confidentially and, except when required by law, patients are given the opportunity to approve or refuse their release.

E. Patients have the right to have their medical record (PHI) accessed and used only by the individuals involved in treatment, payment or health care operations.

F. Patients are provided to the degree known complete information concerning their diagnosis, treatment and prognosis. When it is medically inadvisable to give such information to a patient, the information is provided to a person designated by the patient or to a legally authorized person.

G. Patients are given the opportunity to participate in decisions involving their health care, except when such participation is contraindicated for medical reasons.

H. Patients may refuse treatment to the extent permitted by the law.

I. Patients have the right to expect reasonable safety as to the center’s practices and environment.

J. Patients have the right to know the identity and professional status of the individuals providing care and to know all physicians or practitioners responsible for his/her care.

K. Patients have the right to have a person of their own sex present during certain parts of a treatment or procedure performed by a health professional of the opposite sex and the right to not remain disrobed any longer than is required for accomplishing the purpose for which the patient was asked to disrobe.

L. A patient may not be transferred to another facility unless he/she received a complete explanation of the need for transfer.

M. Patients have the right at his/her own expense, to consult with a specialist.

N. Patients have the right to request and receive an itemized and detailed explanation of his/her total bill for services rendered in the center

O. Information is available to patients and staff concerning:

a. Patient rights; including those specified above.
b. Patient conduct and responsibilities.
c. Services available at the Medical Center of Newark.
d. Provisions for after hours and emergency care.
e. Fees for services.
f. Payment policies.
g. Patient’s right to refuse to participate in experimental research.
h. Methods for expressing grievances and suggestions to the Medical Center of Newark.

P. Patients are informed of their right to change primary or specialty physicians if other qualified physicians are available.

Q. Any infraction or complaint concerning these rights should be brought to the attention of the Complaint Officer and/or Facility Administrator.
